How to Submit a Copyright Infringement Notice

If you believe that material on ReadMultiplex.com or Multiplex.FM infringes your copyright, send a written notice to our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, with information reasonably sufficient for us to locate it (for example, the exact URL, or for Multiplex.FM broadcasts, the date, time and program name).
  4. Information reasonably sufficient to permit us to contact you, such as your name, postal address, telephone number and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

A notice that does not substantially comply with these requirements may not be acted on.

What Happens After We Receive a Valid Notice

When we receive a notice that substantially complies with the requirements above, we will act expeditiously to remove or disable access to the material identified. Where the material was posted by a user, we will take reasonable steps to promptly notify that user that the material has been removed or disabled.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may send a written counter-notification to our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which First American Resources, Inc. may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

When we receive a valid counter-notification, we will promptly provide a copy to the person who sent the original notice and inform them that we will replace the removed material or cease disabling access to it in 10 business days. We will restore the material not less than 10, nor more than 14, business days after receiving the counter-notification, unless our Designated Agent first receives notice from the original complainant that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material.

Repeat Infringers

It is our policy, in appropriate circumstances, to disable and/or terminate the accounts of users, including members and forum participants, who are repeat infringers.

Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. If you are not sure whether material infringes your copyright, or whether a use may be a fair use, you may wish to consult an attorney before sending a notice.
